Terms of Service

1. Agreement

By accessing or using the purplebutter platform at purplebutter.io ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms constitute a legally binding agreement between you and purplebutter.

2. Description of Service

purplebutter is a threat-informed security awareness training platform. It provides:

• A library of interactive security awareness training games, free to play for anyone, with no account required
• SCORM-compatible training packages for enterprise LMS deployment, available under a separate Enterprise agreement

3. Free access

The full game library is free to play for anyone, at any time, with no account, sign-up, or payment required. We reserve the right to change this at any time, but any such change will not apply retroactively to remove access that was previously free.

4. Enterprise terms

Organizations that want to deploy the training library through their own Learning Management System (LMS) can request a SCORM export via the contact form. Enterprise access is governed by a separate agreement entered into with us and is not self-service. Enterprise customers receive a company-wide license that permits employees in the licensed organization to access the training content through the customer's LMS.

SCORM packages are provided for internal use only by the licensed organization and may not be resold, redistributed, or sublicensed without written permission.

5. Acceptable use

You agree not to:

• Share, redistribute, or resell training content, game files, or SCORM packages outside the scope of your license
• Reverse engineer, decompile, or extract source code from games or platform components
• Use the Service for any unlawful purpose or to facilitate actual cyberattacks
• Attempt to gain unauthorized access to platform infrastructure
• Automate access to the Service (scraping, bots) at a volume that degrades the Service for other users, without written permission

We reserve the right to restrict access for use that violates these terms.

6. Intellectual property

All content on the platform — including game designs, game code, artwork, and text — is owned by purplebutter or its licensors and is protected by copyright and intellectual property laws.

Free access grants you a limited, non-exclusive, non-transferable license to play the games for personal, non-commercial use. Enterprise customers receive the additional rights set out in their Enterprise agreement.

7. AI use and transparency (EU AI Act)

In the interest of transparency, and consistent with the transparency principles of the EU Artificial Intelligence Act (Regulation (EU) 2024/1689):

• AI-assisted development. This platform — including its website, application code, and portions of its training game content and copy — was built with the assistance of general-purpose AI systems (e.g., AI coding and writing assistants). All AI-assisted output is reviewed by us before publication.
• No high-risk AI use. The Service does not itself deploy an AI system to make decisions about you (for example, no automated scoring of your suitability for employment, credit, or similar consequential decisions). Any automated scoring within a game is a fixed, deterministic pass/fail rule authored by us, not a machine-learning model acting on your data.
• No synthetic content impersonating real people. Where a game references deepfakes, AI-generated phishing, or similar threats as training subject matter, this is clearly presented as illustrative training content, not as genuine media of a real person.

This section is a transparency disclosure, not a legal determination of regulatory status. If your organization requires a formal AI Act conformity statement as part of an Enterprise agreement, contact us via the contact form.

8. Disclaimer

The training content on this platform is provided for educational and awareness purposes only. It does not constitute professional security consulting, legal advice, or a guarantee of protection against cyber threats.

The Service is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the maximum extent permitted by law, purplebutter shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the free Service. Liability under an Enterprise agreement is governed by the terms of that agreement.

10. Changes to these terms

We may update these terms from time to time. The "last updated" date at the top reflects the most recent revision. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.

11. Governing law

These terms are governed by the laws of Switzerland. Any disputes arising from these terms shall be resolved in the courts of Switzerland, unless mandatory consumer protection laws in your jurisdiction provide otherwise.
